Terms of Use for Drop AI

1. Acceptance of terms
By downloading, installing, or using Drop AI (the "App"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree, do not use the App.
2. Eligibility
The App is intended for users aged 16 and older. By using the App you represent that you meet this age requirement. If you are under the applicable age of majority in your jurisdiction, a parent or legal guardian must review and accept these Terms on your behalf.
3. The service
The App is an AI image-generation service. You provide a photo and either select a template or write a free-text prompt, and the App generates an AI image based on your input. Generation runs asynchronously on our servers and involves third-party AI providers, as described in our Privacy Policy.
4. Accounts
You may use the App anonymously or sign in with Google or Apple. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You must provide accurate information and keep it up to date.
5. Tokens, subscriptions, and billing
5.1 Token-based model
Image generation consumes tokens. Tokens may be granted on signup, included with a premium subscription, or purchased as one-time consumable token packs.
5.2 Subscriptions
A recurring premium subscription provides tokens and/or premium features on a periodic basis. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your platform store account will be charged for renewal within 24 hours prior to the end of the current period.
5.3 Purchases and processing
All purchases — subscriptions and token packs — are processed by the Apple App Store or Google Play through RevenueCat. Token balances are credited to your account after the purchase is confirmed. You can restore previous purchases and manage or cancel subscriptions through your platform store account settings.
5.4 Refunds
Subscription and purchase refunds are governed by the Apple App Store and Google Play policies; direct any refund requests to the relevant platform store. Token packs are consumable: once tokens have been used to generate images, they are non-refundable. We do not provide pro-rated refunds for unused subscription time within a billing period.
5.5 Price changes
We reserve the right to change subscription and token prices. You will be notified of any change in advance, and continued use after the change takes effect constitutes acceptance of the new price.
6. Acceptable use and content rules
You are solely responsible for the photos you upload and the prompts you write. You agree that you will not upload, generate, or attempt to generate content that:
- Is unlawful, infringing, defamatory, or violates the rights (including intellectual property, privacy, or publicity rights) of any person;
- Depicts a real, identifiable person without their consent, or is intended to impersonate, harass, defame, or deceive;
- Is sexually explicit, pornographic, or exploits or endangers minors in any way;
- Is hateful, harassing, or promotes violence or discrimination;
- Contains photos of individuals for whom you do not have the necessary rights or consent to upload and process.
You represent that you have all rights necessary to the photos you upload. We may remove content and suspend or terminate accounts that violate these rules.
7. Ownership of generated content
As between you and us, and subject to your compliance with these Terms, you own the images you generate with the App. You retain responsibility for how you use them. To operate the service, you grant us a limited license to host, store, process, and transmit your inputs and outputs (including sending them to our AI providers) for the purpose of providing and improving the App. You acknowledge that AI systems may produce similar outputs for other users and that outputs are not guaranteed to be unique.
8. AI-generated content disclaimer
Images are generated by artificial intelligence and may be inaccurate, unexpected, or not reflect your instructions. We make no guarantee as to the quality, accuracy, appropriateness, or fitness of any generated result. Generated images may not be suitable for every use, and you are responsible for reviewing outputs before relying on or distributing them.
9. License to use the App
Frostskull AB grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, in accordance with these Terms. You agree not to reverse engineer, decompile, or disassemble the App, use it for any unlawful purpose, attempt to gain unauthorized access to its systems, or remove any proprietary notices.
10. Intellectual property
The App and all its content — excluding images you generate — including its software, graphics, and UI design, are the property of Frostskull AB or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand features.
11. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that generation will always succeed.
12. Limitation of liability
To the maximum extent permitted by applicable law, Frostskull AB and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the App, including any content generated through it. Our total liability for any claim under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time if we believe you have violated these Terms. Upon termination, your license to use the App ceases immediately. You may stop using the App and delete your account at any time (see our Account Deletion page).
14. Governing law
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sweden.
15. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via an in-app notice or an updated "Last Updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
