Terms of Service for Luma - Alarm Clock

1. Acceptance of terms

By downloading, installing, or using Luma - Alarm Clock (the "App"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the App.

2. Eligibility

The App is intended for users aged 12 and older. By using the App you represent that you meet this age requirement. If you are under the applicable age of majority in your jurisdiction, a parent or legal guardian must review and accept these Terms on your behalf.

3. License

Frostskull AB grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your personal, non-commercial use and in accordance with these Terms.

4. Subscription and billing

4.1 Subscription plans

Access to premium features requires an active subscription. The following plans are available:

  • Weekly: Billed once per week.
  • Yearly: Billed once per year at a discounted rate.
  • Free trial: A limited-duration free trial may be offered before the first billing period. The trial duration and eligible plans are displayed at the point of purchase.

4.2 Auto-renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your platform store account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Free trial

If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your platform store account will be charged.

4.4 Cancellation

You can cancel your subscription at any time through your platform store account settings (App Store or Google Play). Cancellation takes effect at the end of the current billing period; you retain access to premium features until that date. We do not provide pro-rated refunds for unused time within a billing period.

4.5 Refunds

Refund requests are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies. Contact the relevant platform store to request a refund.

4.6 Price changes

We reserve the right to change subscription prices. You will be notified of any price change in advance. Continued use of the subscription after the price change takes effect constitutes acceptance of the new price.

5. Free features

Core alarm functionality is available without a subscription. Certain features — including the full ringtone library, advanced statistics, and detailed mood insights — require an active subscription.

6. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or disassemble the App.
  • Use the App for any unlawful purpose or in violation of applicable laws.
  • Attempt to gain unauthorized access to any part of the App or its underlying systems.
  • Remove or alter any proprietary notices or labels on the App.

7. Intellectual property

The App and all its content — including but not limited to sound files, graphics, UI design, and software — are the property of Frostskull AB or its licensors and are protected by applicable intellectual property laws. These Terms do not grant you any rights to use our trademarks, logos, or brand features.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that alarms will fire under all device conditions (e.g., low battery, Do Not Disturb mode, or OS restrictions).

Luma is not a medical device and is not intended to diagnose, treat, cure, or prevent any sleep disorder or medical condition.

9. Limitation of liability

To the maximum extent permitted by applicable law, Frostskull AB and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the App — including missed alarms or sleep-related outcomes. Our total liability for any claim under these Terms shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time if we believe you have violated these Terms. Upon termination, your license to use the App ceases immediately.

11. Governing law

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict-of-law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sweden.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notice or an updated "Last Updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
